The website used by the data controller is available at the link www.peachesandcream.hu. The website is used to present the services of the data controller. Registration on the website is not possible. The data controller does not process the data of persons under the age of 16. If you become aware that the personal data of a person under the age of 16 has come into the possession of the data controller during the use of the website, the data will be deleted immediately.

For security reasons, the hosting provider stores the IP addresses, browser type data, ISP data, and time stamp in the so-called log file, the duration of which is 1 year. Also for security reasons, the website also stores IP addresses (to prevent hacker attacks), the duration of which is 1 month.

The rights of the data subject:

Right of access: The data subject has the right to receive feedback from the company as to whether his personal data is being processed, and if such data processing is in progress, he is entitled to receive access to the personal data, the purpose of the data processing, the identity of the recipients ( with particular regard to transmission to a third country), the duration of data storage, the source of the data, if it was not obtained directly from the data subject by the data controller.

Right to rectification: The data subject has the right to have inaccurate personal data corrected without delay upon request by the data controller.

Right to deletion: The data controller shall delete personal data concerning the data subject without undue delay if one of the following reasons exists:


the personal data are no longer needed for the purpose for which they were collected or otherwise processed;
the data subject withdraws the consent that forms the basis of the data management (in the case of data management based on consent), and there is no other legal basis for the data management;
the data subject objects to the data processing and there is no overriding legal reason for the data processing (data processing based on a public authority or legitimate interest);
personal data has been processed illegally;
personal data must be deleted in order to fulfill the legal obligation prescribed by EU or member state law applicable to the company.

 

 

The data controller is not obliged to comply with the deletion request of the data subject, if the data processing is necessary to fulfill the legal obligation applicable to the data controller that prescribes the processing of personal data; for the purpose of exercising the right to freedom of expression and information; on the basis of public interest in the field of public health; archiving in the public interest or for scientific and historical research or for statistical purposes; as well as for presenting, asserting and defending legal claims.


Right to restriction: The data controller limits data processing at the request of the data subject if one of the following is met:

the data subject disputes the accuracy of the personal data, in which case the limitation applies to the period that allows the company to verify the accuracy of the personal data;
the data processing is illegal and the data subject opposes the deletion of the data and instead requests the restriction of its use;
the data controller no longer needs the personal data for the purpose of data management, but the data subject requires them to present, enforce or defend legal claims; obsession
the data subject objected to the data processing in the case of data processing based on a public authority or legitimate interest; in this case, the restriction applies to the period until it is determined whether the legitimate reasons of the data controller take precedence over the legitimate reasons of the data subject.
If data management is subject to restrictions based on the previous section, such personal data, with the exception of storage, will only be processed with the consent of the data subject, or for the presentation, enforcement or defense of legal claims, or for the protection of the rights of another natural or legal person, or the European Union or a member state can be handled in the important public interest.

Right to protest: The data subject has the right to protest in the case of legal grounds for data processing based on public authority or legitimate interest, including profiling. In the event of a request for objection from the data subject, the data controller may no longer process the personal data, unless it proves that the data processing is justified by compelling legitimate interests that take precedence over the interests, rights and freedoms of the data subject, or that are necessary for the presentation, enforcement or are related to its protection.

If personal data is processed for the purpose of direct business acquisition, the data subject has the right to object at any time to the processing of his personal data for this purpose. If the data subject objects to the processing of personal data for the purpose of direct business acquisition, then the personal data may no longer be processed for this purpose.
Right to data portability: The data subject has the right to data portability in the case of data processing based on consent or a contract, if the data processing takes place in an automated manner. The data controller ensures that the data subject receives the personal data concerning him/her provided to the data controller in a segmented, widely used, machine-readable format, and that the data subject forwards this data to another data controller. The right to data portability may not adversely affect the rights or freedoms of others, nor may it violate the right to erasure (forgetfulness), and may not be applied if the data management is in the public interest or is necessary for the performance of the tasks performed within the framework of the exercise of public authority conferred on the data controller.
The right to submit a request: You can contact the data controller directly with your request or complaint at the contact details indicated above. If the data controller receives a request related to the above-mentioned rights, the first step is to check whether the request really originates from the right holder. After that, without undue delay, but in any case within one month from the receipt of the request, it informs the data subject about the measures taken following the data subject's request regarding other data subject rights. If necessary, taking into account the complexity of the application and the number of applications, the one-month deadline can be extended by another two months. The company shall inform the data subject of the extension of the deadline, indicating the reasons for the delay, within one month from the date of receipt of the request. If the data subject submitted the request electronically, the information must be provided electronically, if possible, unless the data subject requests otherwise. The data controller may not refuse the information, unless it proves that it is unable to identify the data subject. If the data controller does not take action following the request, it will inform the data subject of the reason within one month, along with the right to appeal to the supervisory authority and the court.

The information and action must be provided free of charge, unless the request of the data subject is clearly unfounded or - especially due to its repetitive nature - excessive, so the company, taking into account the administrative costs associated with providing the requested information or information or taking the requested action. In this case, the data controller may charge a reasonable fee or refuse to take action based on the request.
